END USER LICENSE AGREEMENT
IMPORTANT-READ CAREFULLY BEFORE INSTALLING OR USING THE SOFTWARE.
YOU AGREE THAT YOUR USE OF THE SOFTWARE ACKNOWLEDGES THAT YOU HAVE READ THIS LICENSE, UNDERSTAND IT, AND AGREE TO BE BOUND BY ITS TERMS AND CONDITIONS.
This Software Licensing Agreement ("Agreement") is a legal agreement between you (“the User”) and Aisle 5 Games, Inc. for the use of the game G.H.O.S.T. Hunters (“Software”).
By installing, copying, downloading, accessing or otherwise using the Software, the User agrees to be bound by the Terms of this Agreement. If you do not agree to the Terms, do not use or install the Software and promptly return the Software to the place from which you purchased it for a full refund.
The terms of this license agreement apply to all versions of the Software, including versions downloaded or acquired without charge (“Trial Version”), Full Version for which a fee is charged, and any license key, if applicable.
LICENSE AGREEMENT:
The Software is the proprietary property of Aisle 5 Games, Inc and is protected by state, federal, and international copyright laws and treaties, and intellectual property laws and treaties. The Software is licensed, not sold.
GRANT OF LICENSE
Aisle 5 Games, Inc. grants the User a non-exclusive, non-transferable license to use the Software for personal, non-commercial home use only and in accordance with the terms of this Agreement.
You may load the software into RAM as well as install it on a hard disk or other storage device.
You may not modify, translate, disassemble, reverse engineer, decompile, or create derivative works based upon the Software.
You may not rent, lease, sell, sublicense, lend or otherwise transfer or assign your rights or obligations under this Agreement to any person or entity.
You agree that the Software will not be shipped, transferred, or exported into any country in violation of the U.S. Export Administration Act and that you will not use the Software in violation of any applicable law.
You agree not to use the Trial Version of the Software following the expiration of the trial period unless a full version of the Software is purchased or a license key for the full version of the Software is purchased.
You agree not to distribute a full version of the Software or license key to others.
Any unauthorized distribution of your full version of the Software or license key will result in immediate and automatic termination of your license.
Your license to use the Software will automatically terminate if you breach the terms of this Agreement.
You may terminate this Agreement at any time by destroying all copies of the Software in your possession.
Aisle 5 Games, Inc may terminate this license at any time by giving notice of such termination on the “World Wide Web" at the address http://www.aisle5games.com.
Upon Termination of this Agreement for any reason, you will cease using the Software and will destroy all copies of the Software in your possession or control.
Except as expressly licensed by Aisle 5 Games, Inc. in writing, Aisle 5 Games, Inc. reserves the exclusive copyright and all other rights, title and interest to distribute the Software, and to use Trademarks in connection with them.
NO WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, ARE MADE AS TO THE SOFTWARE OR ANY MEDIUM ON WHICH IT MAY BE LOCATED.
Aisle 5 Games, Inc. AND ITS SUPPLIERS DO NOT WARRANT THAT THE SOFTWARE PRODUCT IS ERROR-FREE OR THAT ACCESS TO THE SOFTWARE PRODUCT WILL BE UNINTERRUPTED AND WITHOUT COMPROMISE TO SECURITY SYSTEMS.
YOU ACKNOWLEDGE AND AGREE THAT YOUR USE OF THE SOFTWARE PRODUCT IS "AS IS," AND "AT YOUR OWN RISK."
IN NO EVENT SHALL Aisle 5 Games, Inc. BE LIABLE FOR OR PROVIDE REMEDY FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL DAMAGES OR ANY DAMAGES WHATSOEVER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF USE, DATA OR PROFITS, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OR PERFORMANCE OF THE SOFTWARE, OR OTHERWISE ARISING OUT OF THE USE OF THE SOFTWARE, EVEN IF Aisle 5 Games, Inc. OR ANY OF ITS SUPPLIERS HAVE BEEN ADVISED OF THE POSSIBILITY OF DAMAGES.
Aisle 5 Games, Inc. SOLE AND EXCLUSIVE LIABILITY TO THE USER FOR ACTUAL DIRECT DAMAGES IS LIMITED TO THE AMOUNT ACTUALLY PAID FOR THE SOFTWARE.
